2. LEGAL FRAMEWORK
This Agreement is governed by:
- Indian Contract Act, 1872
- Information Technology Act, 2000
- Consumer Protection Act, 2019
Electronic acceptance of this Agreement constitutes a legally binding contract.
3. ACCEPTANCE OF TERMS
By booking any trek:
- You confirm you are 18 years or above
- You accept these Terms for yourself and all participants
- You acknowledge that this forms a binding legal contract
4. CONTRACT FORMATION
A contract is formed only when:
- Payment (partial/full) is received
- Confirmation invoice is issued
5. BOOKING & PAYMENT POLICY
- 30% advance required at booking
- 70% balance due 7 days before trek
- Failure to pay may result in cancellation without refund
All payments are processed via secure gateways.
6. PRICING & TAXATION
- Prices are subject to change before confirmation
- Additional costs due to government changes, permits, or transport shall be borne by the participant
7. CANCELLATION & REFUND POLICY
All cancellations must be in writing.

- Vouchers are valid for 12 months
- No cash refunds except where required by law
8. RESCHEDULING POLICY
- One free date change allowed (7+ days prior)
- Additional changes: 10% fee
- Once rescheduled = non-refundable
9. ITINERARY & OPERATIONAL CHANGES
The company reserves the right to modify, delay, or cancel any itinerary due to:
- Weather conditions
- Natural disasters
- Government restrictions
- Safety concerns
Additional costs shall be borne by the participant.
10. MINIMUM GROUP SIZE
- Minimum 6 participants required
- The company may merge or cancel departures
11. FITNESS & MEDICAL DISCLOSURE
Participants must:
- Be physically fit
- Disclose all medical conditions
Failure may result in removal without refund.
12. ASSUMPTION OF RISK (CRITICAL CLAUSE)
The participant acknowledges that trekking involves inherent risks including:
- Injury, illness, or death
- Altitude sickness
- Natural hazards
The participant voluntarily assumes all risks associated with participation.
13. LIMITATION OF LIABILITY
To the maximum extent permitted by law:
- Liability is limited to the amount paid
- No indirect or consequential damages
14. INDEMNITY
The participant agrees to indemnify and hold harmless Trekup India from:
- Claims, damages, or losses
- Legal costs arising from participant actions
15. INSURANCE
- Insurance is not included
- Strongly recommended
- Company not responsible for claims
16. CODE OF CONDUCT
Strictly prohibited:
- Alcohol or drugs
- Misconduct or unsafe behavior
Violation = removal without refund.
17. ACCOMMODATION & EQUIPMENT
- Basic accommodation provided
- Equipment is maintained and safety-checked
- Damage or loss chargeable
18. TRANSPORTATION
- Vehicles assigned based on group size
- Company not liable for delays, breakdowns, or third-party failures
19. LUGGAGE & OFFLOADING
- Participant responsible for belongings
- No liability for loss/damage
- Offloading subject to weight and policy limits
20. RENTAL GEAR POLICY
- Gear provided on a rental basis
- Non-refundable once booked
- Damage/loss chargeable
21. FORCE MAJEURE
The Company shall not be liable for:
- Natural disasters
- Weather disruptions
- Government restrictions
In such cases:
- Credit vouchers or alternatives may be provided
22. UNUSED SERVICES
No refunds for:
- Accommodation
- Meals
- Transport
- Any unused services
23. MEDICAL EMERGENCIES
- All evacuation and medical costs are borne by the participant
- The company may assist, but is not financially liable
24. THIRD-PARTY SERVICES
- Guides, porters, and transport may be third-party
- The company is not liable for their actions
25. MEDIA CONSENT
Participants grant permission for use of:
- Photos/videos
- Marketing purposes
26. DATA PROTECTION
- Personal data is used only for operations
- Shared only when required
27. BLACKLISTING POLICY
Company may:
- Cancel bookings
- Ban participants
For misconduct, fraud, or safety violations.
28. COMPLAINTS & DISPUTES
- Must be reported during the trek
- Written complaint within 7 days
29. ELECTRONIC CONSENT
Online booking constitutes valid legal acceptance under Indian law.
30. SEVERABILITY
If any clause is invalid, the remaining Terms remain enforceable.
31. ENTIRE AGREEMENT
This Agreement overrides all prior communication.
32. GOVERNING LAW & JURISDICTION
All disputes shall be subject to the Courts of Dehradun, Uttarakhand, India
